Platform Terms of Use
These terms govern access to and use of VOHARI, including purchases from independent marketplace sellers. They are designed for a marketplace model: VOHARI provides the platform, payment and trust controls, while sellers remain responsible for the goods they list and fulfil.
1. Who these terms apply to
These terms apply when you visit, register, browse, buy, review products, open support requests, or otherwise use VOHARI. Separate Seller Terms apply to sellers and separate Business & Advertising Terms apply to advertisers. If a mandatory law gives you rights that cannot lawfully be limited, those rights continue to apply despite anything in these terms.
Customer accounts are intended for persons aged 18 or older and persons legally capable of entering into contracts. A parent or legal guardian must supervise any permitted use by a minor where applicable law allows it.
2. Marketplace model and who you buy from
VOHARI is a marketplace platform. A product page identifies the seller responsible for the goods. Unless VOHARI is expressly shown as the seller, the sale of the goods is between you and the independent marketplace seller, while VOHARI facilitates the transaction, payment workflow, marketplace records, customer support and available logistics services.
Sellers must keep listings accurate, maintain stock information, comply with product-safety and consumer laws, issue required tax documents, prepare goods for collection, and honour returns, warranties and remedies required by law and these policies.
3. Accounts and account security
You must give accurate information, keep it current and protect your login credentials. You are responsible for activity performed through your account unless the activity occurred because VOHARI failed to meet a legal duty that cannot be excluded. Tell us promptly if you believe your account has been compromised.
VOHARI may restrict, suspend or close accounts where reasonably necessary to address fraud, unlawful conduct, platform abuse, security incidents, chargeback abuse, repeated policy breaches, sanctions requirements, or risks to users or the platform.
4. Product listings, prices and availability
Sellers control their own product prices unless a promotion is expressly funded or administered by VOHARI. Different sellers may offer similar goods at different prices. Product descriptions, images, compatibility information and specifications must be accurate, but genuine errors can occur. If a material pricing or listing error is identified before fulfilment, the affected item may be cancelled and any amount paid for it refunded.
Adding an item to a wishlist or cart does not reserve it. Stock is reserved only when the checkout flow expressly confirms a reservation, and reservations expire if payment is not completed within the stated period.
5. Orders and contract formation
Submitting an order is an offer to purchase the listed goods. VOHARI may split a single customer order into seller-specific fulfilment orders. An order is not treated as successfully paid merely because a browser returns from the payment provider; payment status is confirmed only after server-side verification from the configured payment provider.
Orders or individual seller items may be cancelled where stock is unavailable, payment fails, fraud controls require cancellation, a listing contains a material error, the product is prohibited, or the transaction cannot lawfully be completed. Amounts already paid for cancelled items will be handled under the refund rules.
6. Payment
Available payment methods are shown at checkout. Payment providers operate under their own terms and privacy practices. VOHARI does not ask you to disclose full payment-card credentials directly to sellers. Payment records are reconciled against VOHARI’s own order records and provider notifications before an order is marked paid.
7. Delivery
VOHARI uses a seller-origin logistics model. Marketplace goods are normally collected from each seller’s registered fulfilment address and delivered to the customer. A multi-seller order can therefore result in multiple collections, delivery charges, waybills, tracking references and arrival dates. The Shipping & Delivery Policy forms part of these terms.
8. Cancellations, returns and refunds
The Returns, Refunds & Cancellations Policy forms part of these terms. It does not reduce rights granted by applicable consumer law. In South Africa this includes rights that may arise under the Consumer Protection Act and the Electronic Communications and Transactions Act.
9. Reviews and user content
You may post honest reviews and other permitted content. You remain responsible for what you submit. You must not post unlawful, defamatory, fraudulent, abusive, privacy-invasive, infringing or manipulated content. VOHARI may moderate content to enforce marketplace rules and may label reviews as verified purchases when its order records support that status.
10. Acceptable use
You may not interfere with platform operation, probe or attack systems without written authorisation, scrape protected content at abusive scale, bypass access controls, impersonate another person, manipulate search or reviews, submit false orders, launder funds, distribute malware, or use VOHARI for unlawful activity. The Acceptable Use & Prohibited Products Policy provides additional rules.
11. Intellectual property
VOHARI’s software, branding, interface and original platform content are protected by intellectual-property law. Seller and advertiser content remains owned by the relevant rights holder, but the contributor grants VOHARI the rights reasonably necessary to host, display, resize, distribute and promote that content for marketplace operation. Rights owners may use the Intellectual Property & Notice Policy to report alleged infringement.
12. Platform availability and changes
We work to keep the platform secure and available, but uninterrupted availability cannot be guaranteed. Maintenance, provider outages, security incidents, force majeure events or network failures may temporarily affect service. Features and policies may change as VOHARI develops. Material policy changes will be published with an updated version or effective date.
13. Privacy and security
Our Privacy Policy explains how personal information is processed. Security measures reduce risk but cannot eliminate every internet threat. You should use strong unique passwords, protect your devices and report suspicious activity promptly.
14. Liability and mandatory rights
Nothing in these terms excludes liability or consumer rights that the law does not permit us or a seller to exclude. To the maximum extent permitted by law, VOHARI is not liable for indirect or consequential loss arising solely from an independent seller’s conduct, third-party content, unauthorised use of a user account, or events outside reasonable control. Where VOHARI is legally responsible, the applicable law determines the remedy.
15. Complaints and disputes
Start with VOHARI Support so the transaction record, seller and delivery information can be reviewed. South African consumers may also have access to the Consumer Goods and Services Ombud, National Consumer Commission or other competent bodies where applicable. Privacy complaints may be directed to the Information Regulator.
These terms are governed by South African law unless mandatory consumer law in another jurisdiction requires otherwise. A court or tribunal with lawful jurisdiction may hear a dispute.
16. Legal notices and operator details
Formal notices to VOHARI must use the legal contact information published on the Legal Information page. Notices to a user may be delivered to the latest email or physical address associated with the user’s account, subject to applicable law.
17. The agreement, precedence and general terms
Your agreement with VOHARI can include these Platform Terms, the Privacy Policy, Returns Policy, Shipping Policy, any payment or promotion terms shown at checkout, and other rules expressly incorporated into a particular service. Seller and Business terms apply additionally to those account types. If documents conflict, specific transaction or service terms prevail for that specific matter, followed by these Platform Terms, unless mandatory law requires another result.
If any provision is invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a right once does not waive it. You may not transfer your account or contractual rights in a way that bypasses VOHARI’s account, seller or security controls. VOHARI may transfer platform rights or obligations as part of a lawful restructuring, financing or sale, subject to applicable notice and consumer/privacy requirements.
